The result of the
Speedway Sedans Australia Modified
Production Sedan Australian Title,
took a step closer to resolution
yesterday, when the Speedway Appeals
Tribunal released a document in
relation to their findings.The
document, 82 pages in length,
highlighted the complexity of the
Appeal which resulted in Todd Doyle,
being disqualified from the result
of the Australian Title after being
first across the line.
Part of Doyle’s reason to appeal
to the Speedway Appeals Tribunal,
was that the Race Control Tribunals
decision was flawed. The Speedway
Appeals Tribunal disagreed. They
also as part of the their 82 page
report were not impressed, with the
refusal of Doyle to answer a
specific question, in relation to
what fuel he used during the racing
meeting in question. Doyle elected
to advise that the fuel used by him
"was in accordance with the Rules
and Specifications", however despite
being posed specific questions by
the SAT at the hearing, the
Appellant refused or failed to
state:
a) whether or not his car was
running on Shell V-Power racing fuel
during the event
b) precisely what fuel
(brand/type/RON/MON/other details he
understood/understands his car was
running in the event.
Doyle was also not happy with the
process of the fuel testing
procedure, which took up more than
15 pages of the extensive report.
The Speedway Appeals Tribunal, is
yet to give a final decision in the
case, instead electing to give the
Appellant (Doyle) the opportunity to
make a written submission to the SAT
specifically regarding the question
of an appropriate penalty. This
comes on the back of Procedural
Fairness to all parties, with the
request to be no longer than 3 A4
pages in length, to be received by 6
October 2008.
A decision will be forthcoming
after this date.
